General terms and conditions for the purchase of online vouchers

1. General information

The contract is concluded between the purchaser as buyer and MATS LECH ALPENQUARTIER (=Chalet Bergblick GmbH), Tannberg 375, A-6764 Lech, as seller. Any deviating provisions are only valid if they have been expressly agreed in writing by both parties. Only persons who have reached the age of 18 are authorised to make purchases in the online voucher portal.

2. Scope of application

These General Terms and Conditions (GTC) apply to the sale of vouchers on the MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) online voucher portal at www.mats-lech.at / www.mats.sellstart.at

Definition:

"Value voucher" = voucher with a specific stored value that can be used as a means of payment for services at MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH).

3. Conclusion of contract, delivery and payment

The vouchers offered on the MATS LECH ALPENQUARTIER website represent a non-binding and non-binding purchase offer, which MATS LECH ALPENQUARTIER is entitled to accept within 72 hours by means of an order confirmation via e-mail, whereby the purchase contract is concluded. If no order confirmation is received within the aforementioned period, the purchase offer is deemed to have been rejected and no purchase contract is concluded.

In order to minimise your order costs, you have the option of paying for the vouchers by online bank transfer or by credit card (Visa, Mastercard, Amex, Diners Club). The vouchers can then be printed out directly and will also be sent to your mailbox by e-mail. (Shipping method: "Download and immediate dispatch by e-mail"). There is no order fee.

If the voucher ordered online has already been sent to the customer before MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) has received or credited the payment due for it, the voucher shall not be valid until full payment has been made and MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) shall therefore be entitled to withhold the services securitised in the voucher until full payment of the fee owed for them. Deviations in the illustrations and photos are possible. Errors and changes to the articles are reserved.

4. Vouchers

In the case of online vouchers, please note that these are sent to the customer by MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) with a forgery-proof code. As the customer can print out the voucher themselves, several prints are possible, but only one print is relevant in terms of value and can be redeemed. If further copies with the same code appear, this constitutes misuse and will result in criminal prosecution.

As a voucher can be passed on or given as a gift, Melitta is not obliged or able to check the right of ownership of the redeemer. When a voucher is redeemed, it is only checked whether the corresponding voucher code has actually been released by the system and whether the corresponding voucher has actually been paid for. Lost vouchers will not be replaced. Vouchers can also not be returned for cash value. If the value of the voucher is more than the service consumed, a new voucher will be generated with the remaining value. In such a case, there is no entitlement to a cash payment of the outstanding voucher amount. The MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) is not obliged to accept unpaid vouchers as a means of payment. Should the MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) have to close or give up for any reason, the online vouchers shall expire without compensation. This may also be the case if the business demonstrably changes ownership. In such a case, MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH) cannot be held liable as the original issuer of the vouchers.

5. Invoicing, value added tax

Due to the legal regulations (UStG), invoices with proof of tax can only be issued at the time of the actual provision of the service. This is the time of voucher redemption. All prices listed do not include VAT, as the voucher itself is a 100% credit note. Only the actual invoice(s) issued by the hotel will include VAT.

6. Redemption

Vouchers can only be redeemed at the MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH). For operational reasons, the services listed in the voucher can only be provided or guaranteed by the hotel if a corresponding and timely reservation has been made.

The right to redeem the voucher expires 30 years from the date of issue, unless a different expiry date is stated on the voucher.

7. Cancellation/return

The voucher can be returned if a cancellation notice is sent to MATS LECH ALPENQUARTIER (Chalet Bergblick GmbH), (Tannberg 375, 6764 Lech / info@mats-lech) within 14 days of receipt without giving reasons. However, the right of cancellation does not apply if the service has already begun within the cancellation period. Otherwise the voucher will be cancelled in the system and the voucher code will lose its validity. Once the process has been completed, the amount will only be refunded to the payment method used during the purchase process. Only customers who are consumers within the meaning of the Austrian Consumer Protection Act can make use of the right of return.

8. Security guarantee, data protection

The security of the customer has the highest priority! For this reason, data such as credit card number, bank code, account number, name and address are transmitted via certified payment providers via their protected SSL line in accordance with PCI guidelines in order to protect the transmitted data from access by unauthorised third parties.

For additional security in the online voucher portal at www.mats-lech.at / www.mats.sellstart.at, further security measures are applied.

The customer's details are processed and stored automatically. The data will not be passed on to third parties in any case.

9. Place of jurisdiction

Austrian law applies exclusively to all contractual relationships. Place of jurisdiction is Feldkirch, Austria.
